This Privacy Policy (“Policy”) describes how The Public Notifier LLC, a Florida limited liability company (“Company,” “we,” “us,” or “our”), collects, uses, stores, and protects information in connection with our website at thepublicnotifier.com (the “Website”) and our public notice compliance services (the “Services”). This Policy applies to all visitors to the Website and all Customers who use the Services.

By accessing the Website or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, you must not access the Website or use the Services.

1. Information We Collect

We collect information in the following categories:

1.1 Information You Provide Directly. When you submit an order, request a quote, contact us, or otherwise interact with the Services, you may provide us with information including your name, email address, phone number, mailing address, business or firm name, project address, parcel identification number(s), approval type, hearing date(s), and any additional project details required to fulfill your order (collectively, “Customer Data”).

1.2 Property Owner Information from Public Records. To perform the Services, we access and process information from publicly available government data sources, including county property appraiser records and geographic information system (GIS) databases. This information may include property owner names, mailing addresses, parcel identification numbers, property legal descriptions, and related data (“Public Records Data”). This data is obtained from public government sources and is used solely to generate the mailing lists, notice letters, and related Deliverables required for public notice compliance.

1.3 Payment Information. We collect payment information necessary to process your transactions. We do not store complete credit card numbers or bank account details on our servers. Payment processing is handled by third-party payment processors, and your payment information is subject to those processors’ privacy policies and security practices.

1.4 Website Usage Information. When you visit the Website, we may automatically collect certain technical information, including your IP address, browser type, operating system, referring URL, pages viewed, time and date of visits, and other standard web log data. We collect this information through cookies and similar tracking technologies, as described in Section 6 below.

2. How We Use Your Information

We use the information we collect solely to provide, maintain, and improve the Services. Specifically, we use your information to:

  • Process and fulfill your orders, including generating mailing lists, notice letters, radius maps, affidavits of mailing, and other Deliverables.
  • Communicate with you about your orders, respond to inquiries, and provide customer support.
  • Verify the accuracy of Customer Data against public records.
  • Calculate statutory deadlines and compliance requirements.
  • Process payments and send transactional communications such as order confirmations and receipts.
  • Monitor and analyze Website usage to improve the user experience.
  • Comply with applicable legal obligations.
  • Protect against fraudulent, unauthorized, or illegal activity.

We do not use your information for any purpose other than providing and improving the Services as described in this Policy.

3. We Do Not Sell Your Information

We do not sell, rent, lease, trade, or otherwise make available your personal information or Customer Data to third parties for their own marketing, advertising, or commercial purposes. We have never sold personal information, and we have no intention of doing so.

4. Information Sharing

We do not share your information with third parties except in the following limited circumstances:

4.1 Service Providers. We engage a limited number of third-party service providers who perform functions on our behalf and are necessary to deliver the Services. These providers may have access to personal information only to the extent needed to perform their functions and are contractually obligated to maintain the confidentiality and security of such information. Our current categories of service providers include:

  • Cloud infrastructure and hosting providers (for secure data storage and application hosting).
  • Form and intake processing services (for receiving customer order information).
  • Print and mail fulfillment providers (for printing and mailing notice letters on the Customer’s behalf).
  • Payment processors (for processing transactions).
  • Analytics providers (for Website usage analysis).

These service providers are used solely to deliver the Services. We do not permit our service providers to use your information for any other purpose.

4.2 Legal Requirements. We may disclose your information if required to do so by law, regulation, legal process, or governmental request, including but not limited to a subpoena, court order, or search warrant. We may also disclose information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

4.3 Business Transfers. If the Company is involved in a merger, acquisition, reorganization, sale of assets, or bankruptcy, your information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on the Website of any such change in ownership or use of your information.

4.4 With Your Consent. We may share your information with third parties when you have given us explicit consent to do so.

5. Data Retention

We retain Customer Data, order records, and Deliverables for a period of three (3) years from the date of order completion. This retention period allows us to support Customers who may need to reference or reorder proof packages for legal proceedings or governmental audits related to their projects.

After the three-year retention period, we will securely delete or anonymize Customer Data and order records, unless a longer retention period is required by applicable law or regulation, or unless we are involved in an active legal dispute related to the data.

Website usage data (such as analytics and log data) is retained in accordance with the policies of our analytics providers and is generally retained in an aggregated or anonymized form.

6. Cookies and Tracking Technologies

The Website uses cookies and similar tracking technologies to collect and store certain information when you visit the Website.

6.1 What Are Cookies. Cookies are small text files placed on your device by a website. They are used to recognize your browser, remember preferences, and collect usage information.

6.2 Types of Cookies We Use. We use the following types of cookies:

6.4 Do Not Track. Some browsers offer a “Do Not Track” signal. The Website does not currently respond to Do Not Track signals because there is no industry-standard protocol for compliance. We will update this Policy if a standard is established.

We implement reasonable administrative, technical, and physical safeguards to protect the information we collect and store. These measures include encryption of data in transit, access controls, secure cloud infrastructure, and regular review of our security practices.

9. Public Records Data

A significant portion of the data we process in performing the Services — including property owner names and mailing addresses — is obtained from publicly available government records. This data is a matter of public record and is accessible to any member of the public through the relevant governmental agency.

We process Public Records Data solely to fulfill our Customers’ statutory public notice obligations. We do not compile, aggregate, or repurpose Public Records Data for any other use, including marketing, data brokerage, or resale. If you are a property owner whose information appears in our records as a result of a public notice mailing, and you have questions about how your information was obtained or used, please contact us at the address provided in Section 12.

10. Children’s Privacy

The Services are not directed to individuals under the age of eighteen (18). We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information promptly. If you believe we have collected information from a child under 18, please contact us at the address provided in Section 12.

11. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. If we make material changes, we will post the updated Policy on the Website and update the “Effective Date” at the top of this Policy. We encourage you to review this Policy periodically.

Your continued use of the Website or Services after any changes to this Policy constitutes your acceptance of the updated Policy.
